In connection with the signing of the Australia-United Arab Emirates Comprehensive Economic Partnership Agreement (“the Agreement”) between the Government of the United Arab Emirates and the Government of Australia (“the Parties"), the Parties agree on Article 5.3 (Global Safeguard Measures) of Chapter 5 (Trade Remedies), as follows:

  1. For the purpose of Article 9 of the Agreement on Safeguards, the Parties agree that in the event that a Party proposes to change its current practice regarding the other Party’s eligibility for the developing country exemption, that Party shall notify the other Party in writing as soon as possible in advance of the proposed change and provide a reasonable opportunity for prior consultations with the other Party.
  2. For the avoidance of doubt, the Parties shall not have recourse to dispute settlement under Chapter 25 (Dispute Settlement) of the Agreement for any matter arising under this side letter.
  3. Any difference that may arise in relation to the interpretation or application of this side letter will be addressed through consultations between the Parties, who will endeavour in good faith to resolve such differences.
  4. The Parties agree that this letter shall constitute an integral part of the Agreement.
