On 21 April 2025, the ASEAN-Australia-New Zealand Free Trade Area (AANZFTA) Upgrade entered into force. Submissions are sought from interested parties to inform Australia’s position on the review of the AANZFTA ISDS mechanism. 

Australia has negotiated ISDS provisions over the past three decades to provide protection for Australian companies investing abroad. ISDS promotes investor confidence and can protect against sovereign or political risk.
