New development: addition of nickel and its alloys to the Charter of the United Nations (Sanctions – Iran) (Export Sanctioned Goods) List Determination 2008

On 22 February 2009 the Minister for Foreign Affairs determined that the following goods be included in the Charter of the United Nations (Sanctions – Iran) (Export Sanctioned Goods) List Determination 2008 (“Iran Sanctioned Goods List”):

Nickel and its alloys, in crude or semi-fabricated form, with either a) a nickel content of 25% or more by weight; or b) a nickel and cobalt content of 30% or more by weight

The Minister determined to add these goods on the basis that they could, if supplied to Iran, contribute to enrichment-related, reprocessing or heavy water-related activities, the development of nuclear weapon delivery systems, or to the pursuit of activities related to other topics about which the International Atomic Energy Agency has expressed concerns or identified as outstanding.

These goods will constitute “export sanctioned goods” for the purposes of the Charter of the United Nations (Sanctions – Iran) Regulations 2008. This means that the direct or indirect sale, supply or transfer of these goods to Iran, or the incorporation of these goods into goods that are transferred to Iran, will be prohibited without the prior authorisation of the Minister for Foreign Affairs under regulation 11 of the Charter of the United Nations (Sanctions – Iran) Regulations 2008.

The revised Iran Sanctioned Goods List will come into effect on 19 March 2009.
